If we look at current karnataka elections, significant percent of constituencies will be influenced by upper middle class people who go by news/internet propaganda. we shall learn from this & try to chart out our election strategy targeting age groups & constituencies.

The other day, CBI advocate Ashok Bhan was seen in the canteen at the time the bail petition came up for hearing it seems. Apparently, he did not have answers to potential questions that the bench would ask so nobody showed up to represent CBI. This was reported in Sakshi.
CBI advocate would have a good idea of the thoughts of the Supreme Court bench. Based on his “bunking” of the hearing, I think CBI has given up hope of stopping Jagan anna’s bail this time. Bail is a right and it has been granted for sure!
The main worry is not about bail, it is about ED’s investigation. The ED adjudicating authority certifying the attached properties as proceeds of crime is worrying because if the adjudicating authority sees enough evidence of crime, then the trial court may sentence Jagan anna. It could be a small technical issue but if the Foreign Exchange related acts see that as crime then the sentence could be more than two years. Again, if the sentence is two years, then Jagan anna’s one year in judicial remand so far can be offset against it and reduce the sentence but unless the order is stayed, he may not be eligible to contest elections.
The problem is ED is that unlike CBI they don’t have to prove any corruption. Many of the common practices of companies in India are illegal according to Foreign Exchange laws. Mysoora Reddy explained that on a TV show once. I am confident that Jagan anna did not indulge in any corruption but he may not have ensured technical correctness of all the funds flow in his companies.

Dont worry about any outcomes as we are prepared to face them.
All this drama is only for the next 10 months and then see what happens.

CBI reports to PM (prime minister) whereas
ED reports to FM (Finance minister). Now you decide which body (CBI or ED) worries you the most. None for me.

It is myth that ED is more powerful. In fact, ED merely took cognizance of chargesheets that CBI filed and used the same to represent it’s case. Everything will have to go to Supreme Court at the end.

        • Gyan

Hi Ram, I agree with you that ED may not be more powerful than CBI in general. In fact, I am aware that ED has less resources at its disposal compared to CBI. However, in Jagan anna’s case, I am more worried about ED because unlike CBI, they don’t have to prove corruption. They just have to show a violation of FEMA. I am confident that Jagan anna didn’t indulge in any corruption so that is impossible to prove. But, FEMA violations happen as a matter of routine with many companies in India. Also, I agree with you that ultimately everything will go to supreme court. However, the CBI special court (same court functions as ED special court too in AP), would give the verdict first and although appeal is certainly going to be accepted by HC and likely by SC, they usually don’t stay the implementation of verdict by the CBI special court.
I hope ED doesn’t find any FEMA violations.

          • ram

FEMA violations if any have to be proven by establishing money trail. CBI has sent LORs to 6 countries and none except one (likely Singapore) has provided the details. These LORs are not easy to obtain regulations in those countries have to be adhered.

If you care to read about FEMA violataions OR how many cases in which ED trails have proven successful, any remnant of pessimism would go away.

            @ Gayan
            Dont worry.

Foreign countries care a foot for CBI or ED. This was evident in the Italian marine case and Helicopter deal case. Leave alone information they wont even talk to these guys bcs they are aware that these guys are big crooks run by politicians in India.

            • nlr2014

The CBI doesnt have time to catch terrorists who put bombs in hyd but have plenty of time to search for something that is not there in Jagan’s case !! Taxpayers money is going in the drain.

Today Appallate tribunal is going to commence its judgement on ED’s second attachment. If cbi plays tricks, then they may use this to stop Jagan’s bail
